('上船协议书Seafarer’sEmploymentAgreement甲方（船东）PartyA(Shipowner)名称中远散货运输有限公司地址中国天津市河北区远洋广场1号NameCOSCOBulkCarrierCo.,Ltd.AddressNo.1OceanPlaza,HebeiDistrict,Tianjin,China乙方(海员)PartyB（Seafarer）姓名出生日期出生地NameDateofBirthPlaceofBirth甲乙双方经平等协商，就乙方上轮任职务达成协议如下：ItisherebyagreedonanequallyconsultationbetweenPartyAandPartyBforemployingPartyBasrankoftoworkonM/V.一、适用的集体协议Theapplicablecollectivebargainingagreement本协议适用的集体协议为《中国船员集体协议（A类）》。ThisagreementisapplicabletoTheCollectiveBargainingAgreementsforChineseCrew(A).二、工资Wage1、乙方在航工资结构和标准为（单位：人民币元/月）CompositionandStandardofWageasfollowingwhenPartyBworksonboard.(Unit:ChinaRMBYuan/Month)岗位工资或实习补贴BasicWageorInternSubsidy超时津贴O/TPay航行津贴Nav.Allowance休假待金LeavePay年休假津贴AnnualLeaveAllowance业绩奖金PerformancePay保障性待遇SocialSecurity合计Total2、工资支付PaymentofWage乙方在航工资，由甲方直接支付给乙方或乙方指定的银行账户，支付币种为人民币。其中,岗位工资、超时津贴、业绩奖金等每月支付；航行津贴在船发放；年休假津贴、休假待金在船员离船后第一个发薪日一次性支付；法定节假日加班费在其后第一个发薪日支付。WageshallbepaiddirectlytoPartyBorhisdesignatedbankaccountsincurrencyofChinaRMB.TheBasicWage,O/TPay,PerformancePayshallbepaidmonthly,Nav.Allowanceshallbepaidonboard，AnnualLeaveAllowanceandLeavePaywillbepaidonnextwagepaymentdayafterPartyBsign-off.,theOvertimePaymentforOfficialPublicHolidaysshallbepaidonnextwagepaymentday.三、协议的生效和终止Thevalidationandterminationofthisagreement1.本协议自乙方任职之日起生效，至乙方解职之日终止。ThisagreementwillbeinforceassoonasPartyBsign-onandwillbeinvalidassoonasPartyBsign-off.2.甲乙任何一方若提前终止本协议，需至少提前7天通知对方；对巴拿马籍船舶，则需至少提前15天书面通知对方。EitherPartyAorPartyBintendstoterminateagreement,theminimumperiodsshallnotbeshorterthan7days.IfPartyBemployedonPanamanianflaggedvessel,theminimumperiodsshallnotbeshorterthan15daysinwritten.四、其它Others1.本协议一式两份，甲乙双方各持一份。乙方所在船舶保留一份副本备查。PartyAandPartyBshalleachhaveasignedoriginalofthisagreement.Thevesselmentionedabovewillkeeponecopyforbeingreviewed.2.甲乙双方已认真阅研本协议内容并自愿签订本协议。如有违约，则应承担相应的法律和赔偿责任。PartyAandPartyBhavefreelyenteredintothisagreementwithasufficientunderstandingoftheirrightsandliabilities.Incaseofbreachofthisagreement,thePartythatbreaksthisagreementshouldbearthelegalliabilityinaccordancewiththeapplicablelaws.3.如有争议，应友好协商解决。协商不成，可依法向甲方注册地法院提起诉讼。Anydisputeshouldberesolvedbyconsultationfriendly.Ifnoagreementcouldbereachedthroughconsultation,theconcernedpartycanfilealawsuitwithacourtinTianjinwherePartyAregistered.甲方代表：乙方：PartyA:PartyB:(forandonbehalfoftheShipowner)协议签订地点：签订日期：Place:Date://(YYYY/MM/DD)',)
