.2.4施工期间现场配合阶段：景观工程竣工验收后个工作日，委托方支付费用为人民币元整，小写元(合同金额的％)。Jobsitecooperatingphase：theclientshallpayRMBofdesignfee,￥:（%ofcontracttotalamount)withinbusinessdayafterthelandscapeconstructioncompletedandpasstheacceptanceexamine:5。3其它:Others甲方需委派一位人员，就此工程设计方向的事宜上,负责批复乙方的设计.如甲方要求乙方对已同意的设计提供重大修改，或进行合同之外的设计工作，应被视为额外服务项目，收费应由甲乙双方共同协定。PartyAshallappointastafftoinchargeofPartyB’sengineeringdesignapproval.IfPartyArequestPartyBtobemakemajoradjustmentonthedesignapprovedbyPartyA,orworkonthedesignoutofthiscontractscope,shouldbeconsideredanadditionalservice，feesshouldbedesignbymutualagreementofbothparties.第六章双方责任Chapter6Responsibilitiesofparties6。1甲方责任ResponsibilitiesofPartyA6。1。1甲方按本合同协定提交的内容，在协定的时间内向乙方提交资料及文件，并对其完整性、正确性及时限负责。另外，甲方还应提供关于场地条件的数据，包括公用事业、地理条件、道路使用权、限制条件等。PartyAshallsubmitthedataanddocumentscontentinaccordingtothiscontractstipulated，inagreedtimelimit,andberesponsibleforitsintegrity,correctnessandtimelimit.Inaddition,PartyAshallalsoprovidethedataabouttheconditionsatthejobsite，includingutilities,geographicalconditions,roaduseright，constraints，etc.6.1.2甲方提交上述资料及文件超过规定期限15天以内，乙方按合同规定交付设计文件时间顺延；期限超过15天以上时，乙方有权重新确定提交设计文件时间。PartyAdelaytosubmittedthedataanddocumentsreferredaboveinexcessoftheprescribedperiodwithin15days，PartyBpostponedeliverthedesigndocumentsinaccordingtothecontractstipulationtime。Ifthedelaytimemorethan15days,PartyBhastherighttodetermineanewsubmittedtimeforthedesigndocuments6。1。3甲方变更委托设计项目、规模、条件或因提交的资料错误，或所提资料作较大修改，以致造成乙方设计需返工时，双方除需另行协商签订补充合同（或另订合同)、重新明确有关条款外,甲方应按乙方所耗工作量向乙方支付返工费。PartyBdesignreworkedcausesbyPartyAchangedesignprojects,scale,conditionsorbecauseofthepresentedmaterialmistakes,ormentionedmaterialmajorrevision.Bothpartiesshallsignasupplementaryagreement（orsignanewagreement)andredefinerelevantterms,PartyAshallpayassociatedreworkfeetoPartyBinaccordingtotheworkload.6。1。4在合同履行期间，甲方要求终止或解除合同，乙方未开始设计工作的,不退还甲方已付的定金；已开始设计工作的，甲方根据乙方已进行的实际工作量，另行议定。Duringtheimplementofthecontract,PartyArequesttoterminateorrescindthecontract，PartyBhasnotstarteddesignwork，doesnotreturnprepaiddeposittoPartya；designworkhasbegun，PartyAcannegotiatewithPartyBforthefeeinaccordingtotheactualworkload.6。1.5甲方应按本合同第五章规定的金额和时间向乙方支付设计费用，每逾期一天,需承担应支付金额千分之二的逾期违约金.逾期超过十四天以上时，乙方有权暂停履行下阶段工作，并书面通知甲方。Partypaythedesignfeeinaccordingtotheclausefifthofthiscontract,Latepaymentshallpay0.2％ofthelatepaymentamountpenaltyperday，ifthelatepaymentisoverduemorethan14days，PartyBhastherighttosuspenditsworkfornextstage,andnoticeinwritingtoPartyA。6.1.6甲方要求乙方比合同规定时间提前提交设计文件时，甲方应支付赶工费。PartyArequestsPartyBtosubmitthedesigndocumentsbeforecontractstipulatedtime，PartyAshallpaytherushcost.6。1。7甲方应为乙方派驻现场的工作人员提供工作、生活交通等方面的便利条件,但费用由乙方自行承担。PartyAshouldprovidePartyB’son—sitestaffswork,livingandtrafficconveniences,butthecostshallbebearbyPartyB.6。1。8甲方应保护乙方的设计版权，未经乙方同意，甲方对乙方交付的设计文件不得向第三方转让，否则，乙方有权索赔。PartyAshallprotectPartyB’sdesigncopyright,PartyAshouldnottransferthedesigndocumentstothirdpartywithouttheagreementofPartyB，orelse,PartyBhastherighttoclaimforcompensation。6.1。9甲方有权在本项目对外宣传时使用乙方标识。PartyAhastherighttousethelogoofPartyBinadvertisingtheproject。6。2乙方责任乙方按本合同协定提交的内容、份数、在协定的时间内向甲方提交成果，并对其完整性、正确性、及时性负责。2。1Partybshallsubmittheresultcontent,numberofcopiesstipulatedintheagreementintime,andberesponsibilityofitscompleteness,correctnessandtimeliness。6。2。2乙方对设计文件出现的遗漏、错误或甲方不满意之处负责修改或补充。由于乙方设计错误造成工程质量事故损失,乙方除负责采取补救措施外，应免收受损失部分的设计费，并根据损失程度向甲方偿付赔偿金.经甲方或上级主管部门审查后，在原定任务书设计范围内的必要修改，乙方负责承担.PartyBshallmodifyorresupplythedesigndocumentifthereappearedomissions,falseorunsatisfiedbyPartyA。DuetotheengineeringqualityaccidentslosscausedbyPartyB’sdesignerror，partyBshallreducetherelevantpartdesignfee，inadditiontotakeremedialmeasuresandbeliabilityforcompensationaccordingtothelosstoPartyA’sdamages。AfterexaminationbyPartyAorsuperiordepartmentsincharge,amendmentsrequestwithinthescopetheoriginalspecificationdesign,PartyBshallbeliable.6。2.3由于乙方自身原因，延误了设计文件交付时间,每延误一天，应减收该项目设计费的千分之二.DuetoreasonofPartyB,ifdeliverytimebeingdelayed，PartyBshouldreducetheprojectdesignfeeof2/1000perdelayeddays.6.2。4乙方交付设计文件后，参加有关上级审查及根据审查结论负责不超出原定计划任务书范围内的必要调整补充。不再计取费用。Afterdeliveringdesigndocuments,PartyBshallparticipateinrelevantsuperiorexamination，andaccordingtothereviewconclusiontoaddnecessaryadjustment.Supplementwithinthescopeoforiginalplantask,shallnotchargeforanyadditionalfee。6。2。5乙方不得向第三方扩散、转让甲方提交的产品图纸等技术经济资料。如发生以上情况，甲方有权索赔.PartyBshallnotspreadortransferproductdrawings,othertechnicalandeconomicdatasubmittedbyPartyAtothirdparty.Ifabovecircumstancehappened，PartyAhastherighttoclaimforcompensation。6.2。6乙方同意配合甲方按工程进度要求调整出图顺序，付款方式可另行协商.PartyBagreestocoordinatePartyAtoadjustdrawingdeliverorderaccordingtotheschedulerequire，paymentmethodcanbeseparatelynegotiatebybothparties。6.2。7乙方必须根据设计标准、技术规范、设计任务说明等相关景观设计标准进行设计,提交符合质量的设计文件.PartyBmustsubmitthequalitydesigndocumentsinaccordancewithdesignstandards，technicalspecificationsanddesigntaskofrelevantlandscapedesignstandards.6。2。8乙方必须在满足方案标准的前提下，选料用材时要注意到景观效果和造价的关系，作到既满足景观效果的要求，又最大限度的降低造价。PartyBshallchoosematerialsqualityinaccordancewithlandscapeeffectandpriceunderthestandardsofscheme，insatisfiestherequirementseffectandmaximumreducecost。第七章补充条款Supplementalcondition7.1合同终止Terminationofcontract7.1。1甲方因自身原因不能履行本合同,应按照合同付清已完成阶段设计任务对应的设计费，并承担合同总额的10%给乙方作为违约金，合同终止。PartyAunabletoperformthecontractduetoitsownreason，shouldpaythedesignfeeofcompletedphaseinaccordancewiththecontract，andbearthe10％ofthetotalcontractamountasliquidatedpenalty,terminatethecontract.7。1。2乙方因自身原因无法履行合同，应退回全部设计费用,并承担合同总额的10％给甲方作为违约金,合同终止。PartyBunabletoperformthecontractduetoitsownreason,shouldpay10％ofthetotalcontractamountasliquidatedpenalty，andterminatethecontract。7.1。3由于不可抗力因素致使合同无法履行时，双方应及时协商解决。Whenunabletofulfillthecontractduetoforcemajeurefactors，bothpartiesshouldberesolvedthroughconsultationinatimelymanner.7.2未尽事宜及争议的解决Unmentionedmattersanddisputeresult7.2.1本合同未尽事宜,双方可签订补充协议作为附件，补充协议与本合同具有同等法律效力。Mattersnotconcernedofthiscontract,bothpartiescansignedasupplementaryagreementasattachments，supplementaryagreementsandthiscontracthavethesamelegaleffect。7.2.2在履行合同的过程中，双方发生争议，应本着友好的原则协商解决,协商不成的,依法提交仲裁委员会仲裁。Duringtheimplementofthiscontract,ifdisputeoccur,shouldberesolvedinnegotiationwiththeprinciplesoffriendlyconsultation.Failedinnegotiation,bothpartycansubmitittoArbitrationCommissionforarbitrationaccordingtolaw.7。2.3本合同适用于中华人民共和国法律。ThiscontractapplytolawofPeopleRepublicofChina7。3其它others7.3.1乙方为本合同项目的服务到施工安装结束为止。ServiceprovidebyPartybtothiscontractshallbevaliduntiltheconstructioninstallationiscomplete.7。3。2甲方委托乙方承担本合同内容以外的工作服务，另行签订协议并支付费用。OtherworksentrustedbyPartyAtoPartyBbeyondtherangeofthiscontract,shallenteredintoseparateagreementsandpayseparatecosts.7.3.3本合同有效期自双方签字盖章之日起2年内有效。Thecontractisvalidafterbothpartiessignedandsealed，thevalidationperiodis2years.7.3。4本合同正本一式两份，双方各执一份，具有同等的法律效力。Thisoriginalcontractinduplicate,eachpartykeepsonecopyandhassamelegaleffect。委托方：(盖章）Client(seal)承接方(盖章)Contractor(seal）签订合同代表（签字）:签订合同代表（签字）：Representatives(signature）:Representatives（signature）:',)
