('劳动安全卫生专项集体合同范本所谓专项集体合同,是指用人单位与劳动者根据法律、法规、规章的规定,就集体协商的某项内容签订的专项书面协议。整理了“劳动安全卫生专项集体合同范本”仅供参考,希望能帮助到大家!劳动安全卫生专项集体合同范本(劳动安全卫生专项集体合同一般应在建筑、化工、交通、冶金、矿山等危险程度较高、职业危害严重、事故多发行业的企业签订)(CollectiveContractonLaborSafetyandHygienecommonlyappliestotheenterpriseswithhighcriticality,severeoccupationalhazardandfrequentaccident,suchasconstruction,chemical,transportation,metallurgy,minefield,andsoon.第一条本合同由___(单位)与___工会根据《劳动法》、《安全生产法》、《职业病防治法》等法律法规以及省、市有关条例规定,结合本企业实际情况,经企业代表和职工代表协商一致签订。Article1Thecontractisestablishedbetween____andtheTradeUnionof____inaccordancewith“LaborLaw”,“SafeProductionLaw”,“OccupationalDiseasePreventionandCureLaw”andrelatedprovincialandmunicipalregulations,basedontheactualsituationandsubjecttotheequalconsultationbetweenCompany’srepresentativeandemployees’representative.1.企业依照国家有关法律法规,加强安全生产管理。建立健全安全生产责任制,劳动安全卫生制度;组织编制安全生产规章制度、安全操作规程及岗位操作规程,组织制定实施安全生产事故应急救援预案。Companymuststrengthentheproductionsafetymanagementaccordingtorelevantlawsandregulations.Companyshouldsetupthesystemofjobresponsibilityandthesystemofsafeproductionandhygiene,organizetoworkoutinternalrulesandregulation,operationalinstructions,postoperationrulesaswellastheemergencysolutionforproductionaccident.2.企业应不断改善劳动条件。有计划地进行安全设施的更新改造,提供资金保证,确保专款专用。Companyshouldgraduallyimprovetheworkingenvironment.Itshoulddesignedlymodifythefacilitiesforsafeproductionandhygiene,affordfundandinsureitsspecialuse.3.企业应对职工进行劳动安全卫生教育和培训,未经培训合格不得上岗作业。特殊工种作业人员必须经过国家有关部门培训,取得相应资格操作证后,方可安排其从事作业。Companyshouldorganizeeducationandtrainingonsafeproductionandhygienewhilepeoplewhofailorhavenotattendedthesafetytrainingarenotallowedforoperation.Operatorsdesignedtospecialpositionscanstartworkonlyafterobtainingtherelatedqualification.4.企业根据各工种的岗位需要,为职工提供符合国家标准及行业标准的劳动保护用品。对不按规定穿戴和不正确使用劳动保护用品和违反操作规程的职工,有权查处。Companyshouldprovidepersonalprotectiveequipmentofnationalandindustrystandards,accordingtodifferentpositionrequirements.Companyisentitledtogiveopinionsandinvestigatetheliabilitiesoftheemployeeswhodon’tdressorusetheprotectiveequipmentaccordingtotherequirements.5.企业对直接从事有毒有害岗位的职工,进行上岗前、离岗时的健康检查,每年定期进行健康检查,并建立职业卫生健康档案。对其他岗位的职工,也应定期进行体检。并及时向工会通报职业病检查情况。Companyshouldorganizetheemployeesdirectlyengagedintoxicandhazardousoperationstotakethehealthcheckupbeforeandaftertherelatedwork,andindividualhealthfilesarearchivedforoperatorsofthisnature.Scheduledhealthcheckupshouldalsobecarriedoutfortheemployeesofotherpositions.Theresultofoccupationaldiseasecheckupshouldbeannouncedtotradeunion.6.企业依法按国家、省、市规定要求和时限为职工办理工伤保险,并按时足额缴纳工伤保险费用。职工因患职业病或因工受伤的工资和医疗费,按国家和省、市有关规定执行。Companyshouldcovertheemployeeswithindustrialinjuryinsuranceinaccordancewiththelawbynational,provincialandmunicipalrequirementsandtimelimits,aswellinfullandontimepaythecostofindustrialinjuryinsurance.Medicalexpensesandwagesforworkerssufferingfromoccupationaldiseasesorwork-relatedinjuriesshouldbepaidaccordingtothenational,provincialandmunicipalimplementationoftherelevantprovisions.7.在生产过程中发生工伤事故和严重职业危害时,企业应及时报告工会,工会有权依法参加事故调查,提出处理意见并要求追究有关人员的责任。TheoccurrenceofindustrialinjuryandseriousoccupationalhazardduringproductionprocessshouldbereportedtimelytoTradeUnion;TradeUnionisentitledtoinquireintothecaseandgiveopinions,andfurthermoreinvestigatetheliabilitiesofpeopleincharge.8.企业在研究制定和修改劳动安全卫生规章制度、安全技术措施时,工会应参加,涉及职工劳动安全卫生健康的重大问题,须经职工代表大会(职工大会)讨论审议通过。TheTradeUnionshouldtakepertinthestudyingandamendingrulesandregulationsonlaborhealthandsafeproduction,aswellassafetytechniques;anymajorissuesconcerningemployees’safetyandhealthshouldbeconsultedandapprovedbytheEmployeesRepresentativeConvention.9.工会支持企业加强安全生产管理,积极协助行政落实企业安全卫生规章制度,监督国家劳动安全卫生法规的执行。工会有责任教育职工严格遵守企业的各项安全生产规章制度和操作规程,教育和组织职工接受安全技术培训和管理。TradeUnionshouldsupporttheCompanytostrengthenproductionsafetymanagement,activelyassisttheCompanyintheimplementationofhealthandsafeproductionrulesandregulation.Tradeunionhastheresponsibilityofeducatingworkerstostrictlyabidebytherulesandregulationsrelatedtoindustrialsafety,theresponsibilityofeducatingandorganizingemployeestoreceivesafetytechniquestrainingandmanagement.10.工会有权纠正违章指挥,对强令工人冒险作业行为或当发现明显事故隐患和职业危害时,有权停止作业并提出解决的建议,行政应当及时研究答复;当发现危及职工生命安全的情况时,有权组织职工撤离危险场所。TradeUnionisentitledtocorrectimproperinstructionandstoptheoperationandproposesthesolutionswhenworkerstaketheriskorapparentdangeroroccupationalhazardsareobserved;theCompanyshouldmakethedecisionandactionthereafter.TradeUnionisauthorizedtoevacuateemployeesoutofthedangerousplaceswhentheirlivesareexpectedtothehazard.11.其他由企业、职工提出要求协商的与劳动安全卫生有关的问题。OtherissuesregardtohealthandlaborsafetyputforwardbyCompanyandemployeesforfurtherconsulting.第二条本合同由集体合同监督检查小组负责监督,企业应每年不少于一次向职工代表大会(职工大会)报告劳动安全卫生协议履行情况。Article2Thesupervisiongroupofthecollectivecontractisresponsibleforsuperintendingtheexecutionofthepresentcontract.CompanyshouldreporttheimplementationofthecontracttotheEmployeesRepresentativeConventionatleastonceeveryyear.第三条本合同有效期为年,自年月日起至年月日止,并于期满前三个月内进行下一轮劳动安全卫生集体协商。Article3Thevalidityofthecontractis____y(s),startingfrom____to____,andthenextroundofconsultationonhealthandlaborsafetyshallbeginwithin3monthsbeforetheexpi
