活牲畜、家禽的海上、陆上、航空运输保险条款(2009版)

('中国人民财产保险股份有限公司活牲畜、家禽的海上、陆上、航空运输保险条款（2009版）本公司办理活牲畜、家禽的海上、陆上、航空运输保险，其条款规定如下：一、责任范围对于活牲畜、家禽在运输途中的死亡，负责赔偿。二、除外责任本公司对下列原因造成的死亡，不负赔偿责任：(一)被保险人的故意行为或过失；(二)属于发货人所负责任；(三)由于战争、工人罢工或运输延迟；(四)在本保险开始时，被保险活牲畜、家禽健康状况不好；(五)被保险活牲畜、家禽因怀仔、防疫注射或接种所致的死亡；或因传染病、患病，经管理当局命令屠杀或因缺乏饲料而致的死亡；或由于被禁止进口或出口或检验规格不符所引起的死亡。三、责任起讫本保险责任自被保险活牲畜、家禽装上运输工具时开始直至目的地卸离运输工具时为止。如不卸离运输工具，最长的保险责任期限从运输工具抵达目的地当日午夜起算，以十五天为限。在保险有效的整个运输过程中被保险活牲畜、家禽必须妥善装运，专人管理，否则本公司保险人不负赔偿责任。四、货损检验及赔款(一)被保险活牲畜、家禽运抵本保险单所载目的港或目的地以后，被保险人必须及时提货并做到：1、如发现被保险活牲畜、家禽死亡，应即向本保险单所指定的检验、理赔代理人申请检验，如当地无本公司的检验、理赔代理人，可找当地检验机构代为检验。2、如发现被保险活牲畜、家禽的死亡涉及承运人或有关当局的责任，被保险人应即以书面方式向承运人或有关当局索赔。(二)被保险人向本公司索赔时必须提供下列单证：1、保险单或保险凭证正本、提单、发票正本或副本；2、主管当局对事故和牲畜、家禽死亡的证明；3、如涉及第三者责任，还必须提供向责任方追偿的有关函电及被保险人所能提供的其他与确认保险事故的性质、原因、损失程度等有关的证明和资料其他必要单证或文件。(三)本保险索赔时效，从被保险活牲畜、家禽在最后目的地全部卸离运输工具后起计算，最多不超过一年。(四三)在活牲畜、家禽遇险后，由于被保险人立即采取的有效抢救、防损措施而支付的合理费用，本公司保险人负责补偿赔偿，但赔偿补偿金额以不超过保险金额为限。五、赔偿处理保险人在收到被保险人的赔偿请求后，应及时就是否属于保险责任做出核定，并将核定结果通知被保险人。情形复杂的，保险人在收到被保险人的赔偿请求并提供理赔所需资料后三十日内未能核定保险责任的，保险人与被保险人根据实际情形商议合理期间，保险人在商定的期间内作出核定结果并通知被保险人。对属于保险责任的，在与被保险人达成有关赔偿金额的协议后十日内，履行赔偿义务。五六、争议的处理(一)因履行本保险合同发生的争议，由当事人协商解决。协商不成的，提交保险合同载明的仲裁机构仲裁；保险合同未载明仲裁机构或者争议发生后未达成仲裁协议的，依法向人民法院起诉。(二)本保险合同的争议处理适用中华人民共和国法律（不包括港澳台地区法律）。PICCP&CLIVESTOCK&POULTRYINSURANCECLAUSES(BYSEA,LANDORAIR)(2009)ThisCompanywritesinsuranceonlivestockandpoultryshippedbysea,landoraironthefollowingProvisions:I．ScopeofCoverThisCompanyshallbeliableforallrisksofdeathormortalityoftheinsuredlivestockand/orpoultryduringthecourseoftransportation.II．ExclusionsNotwithstandingtheforegoing,thiscompanyInsurershallnotbeliablefordeathormortality:1、CausedbyintentionalactorfaultoftheInsured;2、FallingundertheliabilityoftheConsignor;3、Causedbywar,strikesordelayintransit;4、IftheInsuredlivestockand/orpoultryarenotinagoodstateofhealthatthecommencementofthisinsurance;5、Resultingfrombeinginaparturientconditionorfromvaccinationorinoculationorslaughterbyauthoritiesthroughinfectionsfordiseasesorfromlackoffodder,orfromprohibitionofimportorexportorfailuretopasstest.III．CommencementandTerminationofCoverThisinsuranceshallcommenceontheloadingoftheinsuredlivestockand/orpoultryontothecarryingconveyanceandterminateonthedischargetherefromatthedestination.Incasetheinsuredlivestockand/orpoultryarenotdischargedfromthecarryingconveyancethelongestdurationofthisinsuranceshallbelimitedto15dayscountingfrommidnightofthedayofthearrivalofthecarryingconveyanceatthedestination.Warrantedthattheinsuredlivestockand/orpoultrymustbeproperlyandcarefullyloaded,carriedandlookedafterbyadesignatedcaretakerduringthewholecourseoftransit.IftheInsuredfailstofulfilltheaforesaidobligations,theInsurershallnotbeliablefortheindemnitytothelossordamageattributabletosuchfailure..IV．SurveyofDamageandPresentationofClaim1、TheInsuredshalltakedeliveryoftheInsuredlivestockand/orpoultryingoodtimeuponarrivalthereofatdestinationorportofdestinationnamedinthePolicyandshallundertaketo:applyimmediatelyforsurveytothesurveyingandclaimssettlingagentstipulatedinthePolicyshouldtheinsuredlivestockand/orpoultrybefounddead.IncasethisCompanyhasnosurveyingagentorclaimssettingagentlocally,alocalcompetentsurveyormaybeappliedtoforsurvey;LodgeaclaimwiththeCarrierorthepartyconcernedinwritingincasetheyshouldbeheldresponsibleforthedeathormortalityoftheinsuredlivestockand/orpoultry.2、TheInsuredshallsubmitthefollowingdocumentswhenpresentingaclaimtothisCompany:OriginalPolicyorCertificateofInsurance,originalorcopyofBillofLadingandInvoice;Certificateofdeathissuedbytheauthorityconcerned,givingparticularsandapparentcauseofdeath.Whenthirdpartyliabilityisinvolved,thelettersandcablesrelativetopursuingofrecoverytoandfromtheresponsiblepartyandtheotheressentialcertificatesordocumentsshallbesubmittedinaddition.Theinsuredshouldprovideotherinsurancenatureoftheincidentidentified,causes,extentoflossesandotherrelevantevidenceandinformation.3、Therightoftheinsuredtoclaimforindemnityshalllapseiftheinsuredfailstoexercisesuchrightwithintwoyearsfromthedatetheinsuredisawareoftheoccurrenceoftheinsuredevent.43、ThisCompanyshallundertaketoindemnifytheInsuredforthereasonableexpensesincurredbyhimforhavingimmediatelytakeneffectivemeasuresinrescuingtheinsuredlivestockand/orpoultryfoundindangerbuttheamountofsuchindemnityshallnotexceedtheamountinsuredhereunder.V．SettlementofClaimClaimsHandingTheInsurershall,uponreceiptofaclaimfromtheInsured,checkandascertainwithoutdelaywhetherheisliableforthelossordamageandnotifytheInsuredoftheresult.Whereinthecircumstancesofcomplication,theInsurerfailstoascertainthefactswithinthirtydaysofreceivingtheclaimandtherelevantdocumentsfromtheInsured,theInsurershalldiscussandagreeonareasonableclaimhandlingperiodwiththeInsuredaccordingtotheactualsituation.ThentheInsurershallascertainthefactsandnotifytheinsuredoftheresultwithinthisperiod.WheretheInsurerisliableforthelossordamage,theInsurershallfulfillhisobligationsofindemnitywithintendaysofreachinganagreementontheamountofindemnitywiththeInsured.Ⅵ.TreatmentofDisputes1、Anydisputesarisingfromimplementationofthiscontractofinsuranceshallbesettledbythepartiesthroughnegotiation.Failingwhicharbitrationmaybeappliedwiththearbitrationorganizationspecifiedinthecontractofinsurance;Whereanarbitrationorganizationisnotspecifiedinthecontractofinsurance,orthepartiesconcernedfailtoreachanyarbitrationagreement，alawsuitmaybefiledtothePeople’sCourts.2、ThisinsuranceissubjecttoChineselawandpractice.(notincludeHongKong,MacaoandTaiwanregionallaw)Englishtranslationisforreferenceonly.ForanydisputesfrompolicyinterpretationChinesepolicywillprevail.',)
